Criminal defendants can appeal a conviction. Visa applicants who are refused entry to Australia can seek a merits review. Participants denied support under the NDIS can apply for an internal review. Now consider the patient denied publicly funded access to a medicine. There is no equivalent merits-based right of appeal.
Criminals and migrants have formal rights of appeal, but not Australian patients. Why?
